This Agreement is drafted in the English language. If this Agreement is translated into any other language, the English language text shall prevail.

The website (the “Website”) is operated by Bangor University (registered charity number 1141565) of College Road, Bangor, LL57 2DG (the “University”) (“Bangor, or “We” or “Us”).

The Website provides access to a database developed by Bangor (the “Database”). These terms and conditions (“Terms”) set out Your rights and obligations in using the Website.  By using the Website and associated Database you (“You” or “Your”) agree to be bound by these Terms and data collection notice.

1.     Links

1.1  This Website may contain links to other websites that may be of interest to You. Such websites are operated and controlled by third parties and their inclusion does not imply any endorsement or approval by Us of the materials on such third party site. 

1.2  Please note that these Terms refer only to the Website and are not intended to apply to the websites of other companies to which We may provide links. We are not responsible for the terms or privacy practices of such other sites. You should ensure You check the terms and privacy policies of such other sites if You decide to use them.

1.3  We make no guarantees that the Website and/or database are free from viruses. It is strongly recommended that you check for such viruses before downloading it or its contents.

2.     Use

2.1  The Website and associated Database is for non-commercial use.

2.2  Subject to clauses 2.3 and 3.4, You are permitted to use and share the information on this Website and the associated Database for your personal use and research purposes and ensuring appropriate credit is given to Us.

2.3  You shall not be entitled to modify, supplement, rearrange or split the contents or structure of the Database or to set up derived databases.

2.4  You agree that You shall not:

(a)  use the Website for illegal purposes and will respect all applicable laws and regulations.

(b)  use the Website in a way that may impair the performance, corrupt the content or otherwise reduce the overall functionality of the Website.

(c)  compromise the security of the Website or attempt to gain access to secured areas or sensitive information.

(d)  To offend, defame or racially abuse any person.

3.     Intellectual Property Rights

3.1  The Database consists of information which is publicly available and which has been formulised into a database for ease of access. Database users will be able to access information on the perceptions of European travellers about areas in Wales and the reasons why travellers chose to visit them.

3.2  The look and feel of the Website shall remain the property of the University.

3.3  Nothing in these Terms shall grant You rights to Bangor’s intellectual property rights, including but not limited to trademarks, trading names or otherwise.

3.4  Some information, images or links contained on this Website may be the intellectual property of third parties and subject to separate terms and conditions which You will be required to comply with. Bangor does not seek to offer any licences to any third party copyright material.

4.     Limitation of Liability

4.1  We do not guarantee that the Website and/or Database shall be available 24x7x365.

4.2  The Database and Website is provided "as is" and We do not provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this Website and/or Database for any particular purpose.

4.3  Neither the Parties nor any third party who has been involved in the creation, production or delivery of the Database and/or Website shall be liable for any direct or indirect damages arising out of the use of, or the inability to use, the Database and/or Website.

4.4  Bangor does not guarantee that the Database will be usefully accessible in every hardware or software environment. 

4.5  The content of the pages of this Website and Database is for Your general information and use only and is subject to change without notice.

4.6  You acknowledge that such information and materials may contain inaccuracies or errors and We expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

4.7  We shall not be liable for any indirect, incidental, consequential, liquidated, special, punitive or exemplary damages or penalties to You including, but not limited to loss of business, revenue or profits or otherwise as a consequence of using the Website and/or any data from the Database.

4.8  Nothing in these Terms shall exclude or limit liability for death, personal injury or fraudulent misrepresentation.

4.9  Bangor’s maximum liability under this agreement shall be limited to £1000.

5.     General

5.1  These Terms shall be governed by the Laws of England and Wales and shall be subject to the non-exclusive courts of England and Wales.

5.2  Failure by any Party to exercise or enforce any rights conferred upon it by these Terms shall not be deemed to be a waiver of any such rights or operate so as to prevent the exercise and enforcement at any subsequent time or times of that right or any other rights.

5.3  If any provision of these Terms shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable in whole or part, such invalidity or unenforceability shall not affect the other part of the provision or the other provisions of these Terms, which shall remain in full force and effect.

6.     Privacy Policy and Data Protection

6.1  The University is a Registered Data Controller as defined by the Data Protection Act 1998. Any personal details collected through this Website and provided by You will be processed in accordance with the Act, and will only be used for the purpose or purposes stated on the Website.

6.2  Information collected on this Website is owned by Bangor. We will not sell, share or rent this information to others in ways different from what is stated in this Policy or as set out on the collection point on the Website.

6.3  We collect various personal details when You fill in any registration and ‘contact us’ forms (such as your name, address, phone number, email address etc…).

6.4  We may organise conferences or other events associated with the Database or information it contains with CAWCS, Swansea University and AHRC. Other event partners may include The National Library of Wales, The Wales Literature Exchange, Ceredigion Museum, Swansea Museum and Gwynedd Museum. If you wish to be contacted in relation to such events, please let us know. We may need to share Your personal data with such other parties in order to administer the event(s). Depending on your contact preferences, we will contact you by e-mail or post, telephone or SMS so that You receive the information relating to the event and/or Database. You may opt out of receiving any at any time by contacting the Research Assistant of the “European Travellers to Wales” project, or by e-mail to or by telephoning 01970 631021.

6.5  Cookies are small text files that are placed on Your computer by websites that you visit. They are widely used in order to make websites work, or work more efficiently, as well as to provide information to the owners of the site. By using the Website You are agreeing that we can place cookies on Your device. Currently the cookies may include your language preferences and information on the pages within the Website which you visit. However, all usage data is aggregated and does not show the activities of any given individual or computer. We only use cookies to enable us to provide the best online service for users. Our analytics data includes information about Your computer and includes your IP address, browser type, domain name, access times and referring website addresses. This information is used by Us for the operation of the service, to maintain quality of service and to provide general statistics regarding use of the Website.

6.6  We use Your personal information to provide the services stated on our Website and also for administration/statistical purposes. The information You provide to us via the Website will not be transferred to third parties unless we have your permission to do so.

6.7  We may be required to share Your information as necessary in order to comply with a court order, to co-operate with Government officials or other law enforcement agencies.

6.8  The University secures Your personal information from unauthorised access, use or disclosure.

7.     Correction/Updating Personal Information

7.1  If any of Your personal information changes, or if You no longer desire Bangor services or information, We will correct, update or remove Your personal information.
